Music Artists - Take Control

The Internet has forever changed the music business. The following articles delves in deep explaining contracts and various aspects in relation to the music business....

In the past Record Companies had a lot of control of artists (writers/musicians), most contracts would include funding of recording sessions, production, distribution, marketing, advance (loans) and handling of accounts. Contract obligations for writers to submit all their works (songs/instrumentals) to the Record Company which was then approved or not approved for pending releases. Often Record Companies would own the rights to writers works to do whatever with those songs and instrumentals. Often artists were under a lot of stress, certainly the music business is a very competitive beast and no doubt it can place enormous demands on the artists to recoup huge costs.

The Good News . The Internet has change the way Record Companies deal because new technology has lowered the cost to produce music therefor most artists can now afford to setup their own state of the art recording/production suite using a computer, software and audio hardware interface. Also the Internet has made it so much easier to get the music out there, to get unknown artists worldwide exposure.

Many artists have gone independent because they want to take total control of their music career. The Internet opens up many opportunities to promote and distribute music in various formats such as MP3, iTunes, PodCast, Radio, YouTube Video and complimenting all that with the sale of CD's.. This is a dream come true for a lot of talented artists who want to get there music out there and combine that with clever marketing strategies may reap great success.

Nowadays a lot of record labels will provide manufacturing and distribution deals giving the artists control. In the long run this is a far better deal for the artists especially if they achieve great success.

Record Contracts Explained

It's highly advisable that a music attorney oversees all the details of a contract then the artists should arrange a meeting, ask questions about any concerns to get a better understanding before signing a contract.

Please note that all contracts are not exactly the same, the following are examples only

Basic Contract
This is where everything relating to the artists career is handled by producers, promoters, marketing people, and managers. The artists (writers/musicians) become a product that is given massive saturation to promote and sell. The artists are also required to perform in concerts, appear for interviews! This is no walk in the park and at times can be very stressful.

The artist often gets an advance (loan) from the record company, in return the artists will not have final say in matters such as creative decisions. Not all artists have great success and in the contract usually the record company owns the rights to the artists songs, to do whatever it pleases such as using a song for a diaper commercial on TV.

Licensing
This is actually similar although better than a basic contract (above)

A License Deal will give the record company a limited time (years) to retain control of the artists and works after the specified years have expired the artist retains the copyrights and ownership of their works (songs and instrumentals)

No two deals are all the same especially with a Licensing Deal, there is a period of time signed and agreed to anywhere between 5 to 10 years where the record company has the right to exploit the artists works.

The good news is, after the agreed years has expired the rights revert back to the artists. In that regard this isn't such a bad deal. However! Once the record company loses those rights less or no financial support will be given to the artists, basically the artists will retain their rights therefor earn more in licensing fees but receive less financial support from the record company.

Standard Distribution
The good news is, the record company finances just about everything, the recording, manufacturing, distribution, marketing, promotion. The artist gets royalties after all costs are repaid.

The bad news, usually with a standard contract the artists (Writers/Authors) signs away their copyrights, the record company owns the copyrights indefinitely.

Profit Share Deal.
The artists will usually get a small advance (loan) yet retained ownership of their works and receive more of the share on sales. This deal is good but success in sales is no guarantee.

Manufacturing and Distribution
The artist finances the recording, production and master. The record company manufactures and distributes the product.

Depending on the contract the record company may also finance promotion/marketing but this sort of M&D Deal is rare with major record companies because they will make less to the point of not being profitable.

The artist has total creative control and retain copyrights. The M&D Deal is good but only if the artist has great success with marketing and sales.

Self Distribution

The artists pays for recording, production, manufacture CDs. Usually the artist will have a website up and post their works on various other sites such as CD Baby, SoundClick, Stars of Wisdom, MP3, iTunes and MySpace.

The artists has complete control and the writer own the copyrights entirely without any restrictions. Self Distribution does not come cheap, the costs for manufacturing and promotion/marketing which also requires regular tours, concerts to help sell the CD's. A small business loan is an option and there are many resources available such as getting your music distributed to Radio stations. No doubt, the Self Distribution is a risk but with a lot of effort some artists may have great success.

The best thing about Self Distribution is that the artists will make more on sales and have total control of their creative directives and careers. But not all artists are successful because the music business is a very competitive beast.

Marketing Strategies

Post two or three songs or provide short samples of all your songs and make them available for free download. Then provide access for the customer to purchase the CD.

The important thing is to provide excellent brief description of the music. Great presentation is very important too and if possible include a E-Newletter, fan lists to keep in contact with potential customers.

Register and post your music and presentation on as many websites as possible. "Exposure is the key to successful marketing" Basically you want to get the band plenty of exposure. Also, pitch your presentation to music publicist, magazines, newspapers and TV talk shows and TV music video. You'll also want to consider producing a Video Clip.

If you're very serious about your music career and believe your music has great potential then consider taking out a small loan to pay for costs such as CD manufacturing, Video Clip, Merchandise (such as: T-Shirts, Posters, Cups, Drink Holders) and include costs for Advertising and Promotion.

Register your songs with royalty collection associations / societies. Example: Australia has an association: APRA (Australasian Performing Rights Association) or for USA residents either: ASCAP, BMI or SESAC.

Contact Radio Station Networks! Get your music out there on Radio. Make sure all these Radio Stations are registered/legit so that your music is being properly listed. For example: Programmers keep on file all playlists which are sent to royalty collection associations/organizations which in-turn pays the songwriters (authors) royalty fees on a yearly basis.

Prepare the band to perform at popular venues and clubs. Contact booking agents, send a one page presentation and include the CD. Keep all presentations to one page, one or two photos with an excellent brief description of the band.
